These Terms of Service ("Terms") govern your use of the ParcelApps suite of products and services operated by Eagleminds Technologies Private Limited ("ParcelApps", "we", "our", or "us").

By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using any ParcelApps product, you agree to these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Services

ParcelApps provides software-as-a-service solutions for businesses, including:

  • ParcelPOS: Restaurant point-of-sale system
  • TrackFee: Fee collection and management platform
  • TrackNew: Service CRM and business management
  • TrackFina: Financial management platform

3. Account Registration

To use our services, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities under your account

4. Subscription and Payments

Pricing

  • Subscription fees are as specified on our website or in your agreement
  • Prices may change with 30 days notice for new billing periods
  • All fees are in Indian Rupees unless otherwise specified

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is due upon invoice
  • We accept payment via credit card, debit card, UPI, and bank transfer

Refunds

  • Annual subscriptions may be eligible for pro-rata refunds within 30 days
  • Monthly subscriptions are non-refundable
  • Free trials convert to paid subscriptions unless cancelled

5. Acceptable Use

You agree not to:

  • Use the services for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit malicious code or interfere with the services
  • Attempt to gain unauthorized access to our systems
  • Use the services to store or transmit sensitive personal data beyond what's necessary for the service

6. Intellectual Property

Our Rights

  • ParcelApps and its licensors retain all rights to the services and underlying technology
  • Our trademarks, logos, and service marks may not be used without permission

Your Rights

  • You retain all rights to your data
  • You grant us a license to use your data to provide the services

7. Data Protection

  • We process data in accordance with our Privacy Policy
  • You are responsible for obtaining necessary consents from your customers
  • We implement reasonable security measures to protect data

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • We may perform maintenance with reasonable notice
  • We are not liable for downtime due to factors beyond our control

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to the fees paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for loss of data, revenue, or business opportunities

10. Indemnification

You agree to indemnify ParcelApps against claims arising from:

  • Your use of the services
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

By You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period

By Us

  • We may suspend or terminate accounts for violations of these Terms
  • We may discontinue services with 90 days notice

Effect of Termination

  • Your right to use the services ends immediately
  • You may export your data within 30 days of termination
  • We may delete your data after 90 days

12. Dispute Resolution

  • These Terms are governed by the laws of India
  • Disputes shall be subject to the exclusive jurisdiction of courts in Bangalore, Karnataka
  • We encourage resolution through good-faith negotiation first

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after changes constitutes acceptance.

14. General Provisions

  • These Terms constitute the entire agreement between you and ParcelApps
  • Our failure to enforce any provision does not waive our right to do so
  • If any provision is unenforceable, the remaining provisions remain in effect
  • You may not assign these Terms without our consent
